Terms of Service

These Terms of Service ("Terms") govern your access to and use of HyperBot, a product of HyperWare ("HyperWare," "we," "us," or "our"), including our Discord bot, Twitch bot, the HyperActive Sportsbook & Casino, HyperBot Pro, and the Admin Dashboard at admin.hyperbothub.com (collectively, the "Service"). By inviting HyperBot to a Discord server, linking a Twitch channel, or using the Admin Dashboard, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service. You must also meet Discord's and Twitch's minimum age requirements. If you configure HyperBot on behalf of a server or channel, you represent that you have authority to bind that community to these Terms.

2. Description of the Service

HyperBot provides moderation, community, and engagement tools for Discord and Twitch, along with an optional in-community economy and the HyperActive Sportsbook & Casino. The Service is configured through the Admin Dashboard. Features may be added, changed, or removed at any time.

3. Accounts and Authentication

You sign in to the Admin Dashboard using your Discord or Twitch account via OAuth. You are responsible for maintaining the security of those underlying accounts and for all activity that occurs under your access. You must notify us promptly of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or the terms, policies, or guidelines of Discord or Twitch;
• Harass, abuse, threaten, or harm others, or facilitate hate speech or illegal content;
• Circumvent, disable, or interfere with moderation, security, or rate-limiting features;
• Attempt to gain unauthorized access to the Service, its infrastructure, or other users' data;
• Reverse engineer, scrape, or resell the Service except where permitted by law; or
• Abuse the in-community economy or casino features, including through automation, exploits, or fraud.

5. Virtual Currency and the HyperActive Sportsbook & Casino

The HyperActive Sportsbook & Casino and any in-community economy use virtual, in-community currency that has no real-world monetary value. This currency cannot be purchased, redeemed, exchanged for real money, or transferred outside the Service. Nothing in the Service constitutes real-money gambling, wagering, or a game of chance for value. Virtual currency and casino features are provided for entertainment within a community only, and balances may be adjusted or reset at any time.

6. HyperBot Pro and Payments

HyperBot Pro is an optional paid subscription billed per server. Fees, billing intervals, and included features are described at the point of purchase and in the Admin Dashboard. Subscriptions renew automatically until canceled. You may cancel at any time from the Admin Dashboard, and cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. We may change subscription pricing with reasonable notice.

7. Third-Party Services

The Service integrates with Discord, Twitch, payment processors, and other third parties. Your use of those platforms is governed by their own terms and policies, and we are not responsible for their availability or actions.

8. Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

9. Termination

You may stop using the Service at any time by removing HyperBot from your server or unlinking your Twitch channel. We may suspend or terminate your access if you violate these Terms, if required to protect the Service or its users, or as otherwise permitted by law.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or be secure, accurate, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, HyperBot and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or community activity, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

12. Indemnification

You agree to indemnify and hold harmless HyperBot and its operators from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or the rights of any third party.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
